Clapham, the Marchioness, Southall, Herald of Free Enterprise, Selby, Sea Empress, Braer. Or what about Guinness, Blue Arrow, Polly Peck, Enron, Worldcom? All of these names strike a forbidding note within the boardrooms of UK plc. Some involve health and safety; others, financial scandals. Some have seen directors led away in handcuffs; others, the destruction of some of the largest companies in the world. The worst have seen loss of life on a dramatic scale. Each in its own way signifies some degree of failure on the part of the managers, directors and other board members of companies, be they small or large. As far as environmental matters are concerned, could directors be put in the dock for what are perceived as crimes against the environment? This paper examines some of the issues which are central to directors liability for actions adversely affecting the environment.
