Synopsis

The technical guidance in CLR 7-10 published in March changed the landscape for human health risk assessment. The CLEA guideline values provide generic levels for assessing the potential risks to human health from contaminated soils. Bioaccessibility tests have recently gained wide acceptance chronic exposure to as a means of providing evidence that naturally occurring arsenic does not pose a significant risk to human health. Since March, several consultants have wrongly tried to apply the results of bioaccessibility tests to the CLEA guideline values, ICRCL trigger thresholds or even to trigger values that aim to protect flora rather than humans. If this misuse is allowed to continue, it will undermine regulatory acceptance of bioaccessibility tests and result in increased unnecessary remediation of soils with naturally elevated arsenic concentrations. The tests can only be applied to specific pathways and not to all contaminants.
