Synopsis

A number of regulatory requirements are in place in the UK to deal with historically contaminated land and to prevent future contamination of land. These include the pollution prevention and control (PPC) regime, the contaminated land regime (Part IIA) and the planning system. Under PPC, there is a requirement for operators to establish baseline conditions at a site and to present this data as a site report. This report is required to detail the current and historical activities at the site and outline the pollution potential posed by the site. At minimum, a site report will include details of a site walkover and desktop assessment but there might also be a requirement to carry out intrusive assessment to characterise the conditions at the site. This paper aims to outline the requirements of site reports for PPC regulated sites, and to give details on the relevance of the data obtained in relation to other regulatory regimes. Moreover, it is intended to aid site owners/occupiers in using the opportunity of PPC regulation to assess and manage any environmental liabilities that a site may present.
